To the extent permitted by applicable law, we may modify this Policy, and the Refunds Instructions it contains, without prior notice to you, and any revisions to the Policy will take effect when posted on the Site unless otherwise stated. Please check the Site often for updates.
Either you are a Freelancer, client or micro-influencer, the cost for setting up and creating your Account is absolutely zero. You have nothing to lose by creating an Account in Pinnpointer.
If client or Freelancer/micro-influencer enter into a Contract (Provided exclusively by Pinnpointer) for completing any project provided by client then in such case the payment term shall be mentioned and instructed in the said Contract agreement.
And Freelancer or Micro- influencer irrevocably authorizes and instructs Pinnpointer, as its agent, to create an invoice on behalf of Freelancer for payment due based upon the understanding and agreement between the Client and Freelancer or Micro- influencer.
Notwithstanding anything mentioned herein or any contract, the client once enters into an agreement shall deposit full advance amount of the consideration agreed in the contract to Pinnpointer which after completion and confirmation of client shall be paid to freelancer/micro-influencer.
Client’s instruction to Pinnpointer to pay a Freelancer is irrevocable. Such instruction is Client’s authorization to transfer funds to Freelancer from the Pinnpointer’s Account. Such instruction is also Client’s representation that Client has received, inspected, and accepted the subject work or expense. Client acknowledges and agrees that upon receipt of Client’s instruction to pay Freelancer, Pinnpointer shall transfer funds to the Freelancer and that Pinnpointer have no responsibility to and may not be able to recover such funds once transferred.
Each Contract between the client and Freelancer/micro-influencer may specifically mention 4 to 5 portion/steps such portion shall be equally accompanied with some percent of Payment as a cost or fees of such portion.
(E.g. if the project consist of 4 steps then the total consideration amount shall be divided into 4 parts and each part consist of 25% of advance amount)
Upon completion of each portion of work, the Pinnpointer’s representative or Freelancer/micro-influencer shall inform the Client for approval and inspection and once the Approval has been received then the Freelancer/micro-influencer shall proceed with the next portion/step and upon completion of Full portion/steps the Client will give their final confirmation based on which Pinnpointer’s shall release the payment to the freelancer/Micro-influencer.
(E.g. if the 1st (First) steps/portion is completed then Pinnpointer’s representative or Freelancer/micro-influencer shall inform the Client for approval and inspection of Such 1st (First) steps and only after completion of whole project and final confirmation from client’s the Pinnpointer shall release the payment to the freelancer/Micro-influencer)
In case at any stage or in any portion, client wishes to terminate the project even before the completion of project/work then Pinnpointer shall refund the payment of unapproved/incomplete portion directly to the client and freelancer/micro-influencer shall not be receiving any payment against such unapproved/incomplete project.
(E.g. If 1 project consist of 5 steps and out of the total 5 steps the client approved until 3rd step and do not wish to continue or not satisfied with 4th Step then in such case the Pinnpointer shall release the payment to the freelancer of such 3 Approved steps and shall refund the remaining amount of incomplete steps directly to the Client.)
In case if client wishes to terminate the project at an early stage even before the completion of first portion/step due to whatsoever reason then in such case Pinnpointer shall refund the Advance amount paid after deducting 3% (Three Percentage) from the total advance amount and Client irrevocably give consent for such deduction.
In case Freelancer terminate or fails to fulfill their obligation under the contract, then Pinnpointer shall refund the Entire amount to the Client.
Notwithstanding anything contained herein above, the client shall not cancel the project after its approval. In case any such cancellations are made after the approval of the project, Pinnpointer shall not be liable to make any refund to the client. Further, any claims/ grievances if any, must be made by the client within the project allocated time frame or within 7 (Seven) days after the project dates. No Claims/grievances shall be entertained after the expiry of such 7 (Seven) days and any claims made thereinafter shall be considered as void.
The client further agrees, understands and acknowledges that any refund so made by Pinnpointer under circumstances as mentioned hereinabove shall be exclusive of any/all government taxes, GST, CGST, SGST and other such government expenses and administration charges. i.e., to say that the refund so made by Pinnpointer shall be made after the deduction of the government levied taxes, expenses and administrative charges.
Notwithstanding anything mentioned herein, in the event if the Client requests for the cancellation of any project or certain Services or Deliverables under any work order or Contract subject to the Freelancer/Micro-influencer using its best efforts to minimize costs arising there from, Client shall upon discussion with the Freelancer or Micro-influencer as the case maybe accompanied with Pinnpointer, on a case to case basis, determine the amount to be paid to the Freelancer in lieu of the milestones reached and completed to the satisfaction of Client under the concerned work Order/Contract and shall instruct the Pinnpointer to release such amount of payment to the Freelancer/Micro-influencer out of the total advance amount and Pinnpointer after releasing such amount and upon deducting necessary fees/commission of Pinnpointer shall refund the remaining amount to the client.
User acknowledges and agrees that Pinnpointer, at its sole discretion, withhold or delay payment in the event of dispute between a Client and a Freelancer/micro-influencer. You further acknowledge and agree that Pinnpointer are not and will not be a party to any dispute between a Client and Freelancer/Micro-influencer over any work order or Contract.
Non-binding dispute assistance (“Dispute Assistance”) is available within 30 days of the date of the last release of funds to Freelancer/Micro-influencer. If Client or Freelancer/Micro-influencer contacts Pinnpointer in writing within 30 days of the date of the last payment to Freelancer/Micro-influencer or completion of any project and requests non-binding dispute assistance for any dispute among them (a “Dispute”), Pinnpointer will attempt to assist Client and Freelancer/Micro-influencer by reviewing the Dispute and proposing a mutual, non-binding resolution.
All notices to a User required by these Pinnpointer’s Instructions will be made via email sent by Pinnpointer to the User’s registered email address. Users are solely responsible for maintaining a current, active email address registered with Pinnpointer, for checking their registered email address and for responding to notices sent by Pinnpointer to the User’s registered email address.
Pinnpointer merely provide a platform for Internet payment services. Pinnpointer do not have any responsibility or control over the Freelancer Services that Client purchases. Nothing in this Agreement deems or will be interpreted to deem Pinnpointer as Client’s or Freelancer’s agent with respect to any Freelancer Services, or expand or modify any warranty, liability or indemnity stated in the Terms of Service. For example, Pinnpointer does not guarantee the performance, functionality, quality, or timeliness of Freelancer Services or that a Client can or will make payments.
